What Is Shariah (Islamic Law)?

The order of life, which is related to economy, law, belief, worship, morality, and social life, determined by the Quran and hadiths is called shariah. It is the whole of the laws that Allah has set, commanded to be believed and lived. Human being by obeying the rules of shariah set by Allah, who knows him best, knows all his needs, weaknesses and wishes, and is closest to him [1]; he puts his personal and social life in order.

According to the Islam, the entire universe; Allah has created everything from the atom to the sun to the galaxies [2]. Every living thing created apart from human acts in a certain order in accordance with the purpose of creation. The sun does not refuse to rise, the wind does not refuse to blow. Man, on the other hand, was created to know Allah, to love him and to serve him [3]. However, it is a will-powered being. If a person who fulfills the necessities of the purpose of his creation by using his will acts in accordance with Allah’s orders and prohibitions, he will both ensure social peace and gain Allah’s approval.

In the history of humanity, many prophets have come and basically preached the same principles of belief to their society (ummah). In basic principles such as halal-haram, orders-prohibitions, these principles of belief are the same as the provisions of shariah. The Quran also mentions the shariah of the past society(ummah) [4]. However, with the arrival of Islam as the last religion, the rules of shariah become mature as in Islam and the provisions of other religions lost their validity [5].

According to Islam, a person who chooses to behave in ways that will not please Allah, disrupt the social peace and violate other people’s rights cannot be left idle and unsanctioned. Shariah is what will ensure this order and justice.

Allah is the judge in the Shariah. No one else has the right and authority to change the haram and halal, to set rules. Prophets also convey the rules that they have learned only from Allah [6].

Sharia today; As it was reflected in the press and enlivened in the minds, it was misunderstood as if it consisted of only criminal acts and sanctions, however, this is an approach that only reduces the Shariah to criminal law. Essentially, sharia is a system that creates the social order, such as justice, mercy, spreading goodness, peace, building good morals, taqwa (Fear of Allah), fighting injustice and evil, and performing worship in the best way. When this order is not fulfilled, the application of criminal proceedings

is also within the scope of Shariah, and it is only aimed at ensuring justice.
